Migration Counselor

Location: New York, NY

FLSA Status: Full Time, Exempt

Classification: Administrative Support Worker

Program: Immigrant and Refugee Services Division: Unaccompanied Minors Program

Reports to: Supervising Attorney and Staff Attorneys

Supervisory Responsibilities: No

Summary: The Unaccompanied Minors Program serves unaccompanied immigrant minors who are detained temporarily by the Office of Refugee Resettlement (ORR) in juvenile facilities in the lower Hudson Valley, Long Island, and New York City. The Migration Counselor will work with a team to provide services to children who are, or have been, in ORR detention. The position includes extensive contact with youth, including youth who have suffered abuse, abandonment, neglect, or other trauma. It requires significant time meeting with detained minors at the ORR facilities.

Essential Duties and Responsibilities include the following. Other duties may be assigned.

Unaccompanied Minors Program

  • Provide services to unaccompanied immigrant minors held in local ORR contract shelters (currently Children’s Village, located in Dobbs Ferry, NY and Lincoln Hall, located in Lincolndale, NY), including: Know Your Rights (KYR) orientations; individual screenings; and follow-up services, including research, assistance with obtaining necessary documents, court preparation.

  • Coordinate and ensure provision of services to detained minors. This includes reviewing daily census reports from shelters, planning shelter visits, regularly coordinating with shelter staff, reviewing release documents, and confirming legal referral.

  • Under attorney supervision, provide direct legal services to unaccompanied immigrant minors in removal proceedings who qualify for immigration relief in matters including, but not limited to: asylum, special immigrant juvenile status, U and T visa applications, TPS, deferred action, adjustment of status, cancellation of removal, etc.

  • Under attorney supervision, provide legal services to unaccompanied immigrant minors (including those who have aged out) in New York State family courts in order to obtain the special findings order necessary to apply for special immigrant juvenile status.

  • Assist the staff attorneys to train, mentor and manage law student interns to provide KYR presentations and conduct screenings; identify forms of immigration relief; work on substantive cases; and conduct research on various legal issues and country conditions.

  • Provide in-house and outreach trainings, presentations and workshops, as directed.

  • Maintain and update case files and the LawLogix case management database.

  • Compile monthly statistics and reports.

  • Translate materials into Spanish, as needed;

  • Participate in calls and meetings with stakeholders;

  • Assist in other special projects for the unaccompanied minors program, as assigned.

Legal Orientation Program for Custodians (LOPC)

  • As necessary, present to custodians of unaccompanied minors who have been released in the New York City area, and provide social service, legal, and other referrals.

  • As necessary, train and manage volunteers and interns to provide presentations and provide follow-up services.

Position Type and Expected Hours of Work:

This is a full-time position. Days and hours of work are generally 9:00 AM to 5 PM Monday - Friday.

Working conditions and physical demands required:

The demands described here are representative of those that must be met by an employee to successfully perform the essential functions of this job.

  • Travel at least 50% of the time using public transportation, traverse city streets; occasionally ascend/descend stairs, and be exposed to outside weather conditions.

  • Sit at a work station and use a computer at least 70% of the time.

  • Carry a laptop to offsite work locations.

  • Ability to operate standard office equipment i.e. copier, fax, scanner, postage machine and printer.

  • Ability to use and respond to phone calls.

  • Ability to file client documents in cabinets.


Education and/or experience required:

  • Graduation from accredited college/university, or equivalent professional training related to the position.

  • Previous experience in immigration law and procedures a plus.

Skills, Licenses, and/or competencies required:

  • Bilingual Spanish and English required.

  • Excellent communication skills, interpersonal skills, and an ability to work both independently and in a highly collaborative team environment.

  • Excellent organization and analytical skills.

  • Commitment to public interest work and/or children’s issues, and ability to work with children.

  • Ability to travel throughout the five boroughs, the Archdiocese and Long Island.
